B.Ed degree from Jammu & Kashmir is not valid for Bihar Teacher's Appointment! Patna High Court

In an important judgement the Patna High Court has given the ruling that the BEd degree holders from different universities of Jammu and Kashmir from 2008 onwards are not eligible for appointment as teachers in the state of Bihar. Hearing a letter patent appeal, the division bench of Chief Justice L Narasimha Reddy and Justice Sudhir Singh dismissed the appeal regarding appointment as teachers on the basis of BEd degree from different universities in the Jammu and Kashmir from 2008 onwards.

The court also observed that those holding such degrees were not eligible for appointment as teachers in the high and higher secondary schools governed by the 2006 Rules because these universities were not recognized by NCTE (National Council for Teachers Education). A writ petition was filed by Asheesh Kumar and others challenging an order dated March 1, 2013, passed by the joint secretary, state education department, clarifying that holders of Bed degrees from the institutions/universities of Jammu and Kashmir as well as from Tribhuvan University would not qualify for appointment as teachers in terms of Bihar Secondary/Higher Secondary Teacher Employment Rules, 2006.
